Perused the order passed by the learned Single Judge on 11.10.2012 in Writ Petition No.8341/2012. Learned counsel appearing for respondent, on instructions, states that, inquiry proceeding pending before the Assistant Charity Commissioner is at concluding stage and statements of the objectors who were impleaded in the proceedings before the Assistant Charity Commissioner, are already recorded. Since the proceedings before the Assistant Charity Commissioner under section 39 is at the concluding stage, no interference need be caused in the impugned order after lapse of about three years. It would be open for the concerned individuals/party to raise challenge in the event of issuance of any adverse order by the Assistant Charity Commissioner.

In view of above, Letters Patent Appeal stands dismissed. 3.

Pending Civil Application do not survive and stands disposed of.
