Mr. Tripathi, learned counsel submits that initially as the validation proceedings were pending, temporary approval was granted. Now the petitioner has got the validity certificate and proposal to that effect is submitted for permanent approval, however, the same is not yet decided.

Mr. Rodge, learned counsel for respondent no.3 submits that the authority would take decision on its own merits.

In case, the proposal (Exh. 'F' Page 29) is pending with respondent no.3, respondent no.3 shall take decision upon it, on its own merits, in accordance with law, expeditiously, preferably within four months.

Writ Petition disposed of. No costs.
