Heard learned counsel for the Petitioner. This petition was taken up, out of turn, for the reason that extreme urgency was projected on behalf of the Petitioner.

When the petition is called out for hearing, we find that the Petitioner is raising grievance with regard to the manner in which the elections to the State Bank of India Officers Association are being conducted by the Respondent Nos.1 and 2. We find that the Respondent No.1 is the State Bank of India Officers Association and Respondent No.2 is the Chairman of the Election Committee Unit, Maharashtra Circle of the aforesaid Association. The said Respondents cannot be covered under the
( 2 ) 67 wp 11525.25 definition of 'State' or even an agency or instrumentality of the State as contemplated under Article 12 of the Constitution of India. It can also not be said that the aforesaid two Respondents are performing any public function, so as to facilitate invocation of Writ jurisdiction under Article 226 of the Constitution of India.

The Writ Petition is not maintainable and hence it is dismissed. 4.
Needless to say, this would not come in the way of the Petitioner initiating appropriate proceedings before the competent Court in accordance with law.
