The learned counsel for the applicant submits that, practically, the investigation in this case is over and, further matter is amicably settled between the parties subsequent to the order passed by the Additional Sessions Judge, Ahmednagar dated 20.09.2016 in Criminal M.A.No.1152/2016. Even the informant, who is present today in this Court is ready to file the affidavit before the Court.

Learned counsel in light of the above change in circumstances, on instructions, seeks leave to withdraw this application with liberty to file an application for anticipatory bail before the Sessions Court, again.

Leave granted. Application is disposed off as withdrawn with the liberty as aforesaid.

The learned Additional Sessions Judge, Ahmednagar is hereby directed to consider the application for anticipatory bail, if filed by the present applicant, in the light of the change in circumstances as aforesaid, uninfluenced by the order passed by this Court dated 19.7.2016 in Criminal Application No.3528/2016 and also his own order dated 20.9.2016 passed in Criminal M.A. 1152/2016.
