These are applications seeking withdrawal of amount deposited by the acquiring body.

Out attention is invited to order passed in Civil Application No.11558/2014 and other companion matters by the learned Single Judge of this Court on 25th November, 2014. The instant appeals also arise out of the same award passed by the Reference Court.

Considering the contentions raised by the applicants, the applications deserve to be allowed and the same are accordingly allowed.

The applicants / claimants are permitted to withdraw an amount to the extent of 50 per cent out of the amount deposited by the acquiring body by furnishing undertaking before the Reference Court that in the event of success in the appeals, the respective claimants shall refund the amount back within a period of twelve weeks from the date of such decision. The balance of the amount of 50 per cent out of the amount deposited by the acquiring body shall be permitted to be withdrawn by the respective applicants / claimants on furnishing solvent security or a Bank guarantee in the like amount, to the satisfaction of the Reference / Executing Court. 5.
Hearing of the appeals is expedited.
Learned Counsel for the appellants undertake to tender paper books within twelve weeks without Roznama.
(4) All Civil Applications for withdrawal of amount are disposed of.
