Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.148 of 2024 registered with Udgir City Police Station, District Latur for the offences punishable under Sections 420, 406, 409, 120-B r/w 34 of the Indian Penal Code and Section 3 of the MPID Act. 3.

The applicant was the Manager of the Udgir Branch of Rajasthani Multi State Co-operative Credit Society Ltd. He hails from the State of Maharashtra. The depositors have lodged the report against the management. Hence, the crime is registered. The applicant has been arraigned as an accused only being the Branch Manager. However, the investigation papers does not reveal that he has received benefits from the amount of fraud nor he has played an

964-ba-1780-2024.odt (2) active role. It seems that he being the Branch Manager has been arraigned as an accused. He is languishing in jail for sufficient time. The material investigation has been completed and nothing is to be recovered from him. Therefore, his further detention would serve no purpose. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Hemant Bhaskar Jakate, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that ; (a) The applicant should not tamper with the prosecution witnesses.

(b) The applicant should attend the police station as and when called on written notice by the investigation officer till filing the charge sheet.
