By the earlier order dated 08.11.2023, this Court has considered the matter on merits and was not inclined to grant bail to the applicant. However, liberty was granted to the applicant to move afresh after receipt of the C.A. Report regarding the blood-stained clothes.

The applicant has now filed the present application on the ground that, though requisition for obtaining the C.A. Report were sent long back, the CA Reports have not yet been received, thereby defeating his right to move the second bail application in terms of the liberty granted vide order dated 08.11.2023. Hence, he has filed the present application even in absence of the C.A. Reports. Jhs/ 1/2

Looking to the fact that this Court has already granted liberty to the applicant to file a fresh Bail Application after receipt of the C.A. Report vide order dated 08.11.2023, and as informed by the learned APP that the C.A. Reports are not yet received. In the circumstances, the present application is allowed to be withdrawn. However, the Mini Forensic Science Laboratory - Dhule is directed to submit the C.A. Report as per the requisition dated 08.03.2023 forwarded by the Mohadi Nagar Police Station, District - Dhule, immediately, and in any case within a period of six weeks from today, to the concerned Police Station Officer. The learned APP is requested to ensure that a copy of the C.A. Report is furnished to the applicant or his relatives forthwith after its receipt. The applicant is at liberty to file the Bail Application after receipt of the said C.A. Report. 4.
The Bail Application stands disposed of as withdrawn with aforesaid directions.

A copy of this order be sent to the Mini Forensic Science Laboratory - Dhule and to the office of the Government Pleader for immediate compliance.
