The learned counsel for the applicant submits that, in paragraph no.9 of the judgment, the Reference Court has discussed the sale instances relied upon by the applicantoriginal claimants, however, awarded compensation at the enhanced rate as claimed by the claimants in toto. Learned counsel submits that if those sale instances are considered, then the market rate of the agricultural land in the said village is more than of Rs.2,000/- per aar.

I have also heard the learned AGP for the State. 4.

In view of the above submissions and for the reasons stated in the application, application is allowed in terms of prayer clause 'B'. Application seeking leave is allowed and disposed of.
