1] Heard the learned counsel for the applicant and learned respondent nos.2 and 3, who suo motu appeared. 2] The learned counsel for the applicant submits that this Court by order dated 14th August, 2019 dismissed the appeal in default. The learned counsel further submits that he had given leave notice from 13th August, 2019 to 23rd August, 2019, hence, the order passed by this Court be recalled.
3] Considering the submissions of the learned counsel for the applicant as well as he was on leave note during the period when the order of dismissal is passed, hence, the order passed by this Court is recalled and appeal is restored.
