At the outset, learned counsel Mr. Joshi appears for informant to assist learned APP. Having regard to the nature of offence, he is permitted to assist learned APP. Criminal Application No. 4406/2024 is allowed.

Learned counsel for Applicant submits that whatever amount is allegedly misappropriated by the Applicant, he is ready to pay the same to the informant within a period of two months.

Statement made on instructions is accepted as undertaking.

Learned counsel for the informant submits that compromise has struck between the parties as far as recovery of the said amount is concerned.

Perusal of the order passed by the Sessions Court indicates that the custody of the Applicant was sought to be required for recovery of the said amount. Now, since no issue of recovery of the amount is involved, Application stands allowed in terms of interim relief.
