Mr. Deshmukh, learned counsel for the applicant, submits that notice to respondent no.4 has been returned unserved despite having been sent through the regular modes of service. He further submits that the address of respondent no.4 was taken from the record of the learned Tribunal as provided by the appellant and that there is no source for the applicant to gather any other address of respondent no.4. Accordingly, the address mentioned in the title clause is the last known and best available address of respondent no.4. In view of the above, he submits that the applicant has filed an application seeking substituted service on respondent no.4.

For the reasons stated in the application, Civil Application is allowed in terms of prayer clause "B".

Issue notice to the respondent no.4 by way of substituted service through paper proclamation in daily newspaper "Punyanagari", Thane Edition. 4.
