The applicant-accused was convicted by Assistant Sessions Judge, Latur for an offence punishable under section 498-A of the Indian Penal Code and sentenced to suffer R.I. For three years and fine of Rs.5,000/-, in default to further suffer R.I. for four months, which was further confirmed in Criminal Appeal No.144 of 2011 by learned Additional Sessions Judge vide judgment and order dated 21st September, 2016. 2.
Learned Additional Sessions Judge, Latur has already taken the applicant into custody.

It is brought to my notice that the applicant was on bail during trial, so also during pendency of the appeal and he has not jumped the said bail. In view thereof, the substantive sentence is suspended and the applicant
criap5432.16 (2) be released on bail on the same terms on which the learned Trial Court has released him.
