The applicant apprehends arrest in connection with Crime No. 128/2022 registered with Shirsala Police Station for the offecnes punishable under section 384, 388, 327, 507 read with 34 of Indian Penal Code, 1860.

The informant has lodged First Information Report in question alleging that accused No. 1 who is sister of the present applicant and the applicant have extracted money from the informant with a threat that accused No. 1 will involve him in false offence of rape. On that threat, from time to time huge amount was extracted from the informant.

Heard the learned advocate for the applicant and learned Additional Public Prosecutor for State. Perused the Bhagyawant Punde

{2} 915-ABA-1412-2022 investigation papers.

Accused No. 1 in the present crime is already arrested and is released on regular bail. Perusal of investigation papers do not reveal any material showing actual involvement of the applicant in the present crime. The applicant was granted interim protection and he has attended the police station and cooperated in the investigation. The investigation papers further reveal that call detail record of conversation between accused No. 1 and the informant is collected by the investigation officer. However, there is no call detail report of conversation between the applicant and the informant. Investigation appears to be almost complete. The applicant's custody is therefore not necessary in the facts of the present case.

The application is therefore allowed by confirming the interim protection.

Till filing of charge sheet, the applicant to attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation. [NITIN B. SURYAWANSHI, J.] Bhagyawant Punde
