The petitioner is challenging the public notice of E-auction sale of the property of respondent No-4-Bank. According to Mr. Bide, the learned Counsel for the petitioner, the complaint of the petitioner is pending with the competent court challenging the order. The petitioner is acquitted in the criminal case. If his complaint is allowed, then there would be no assets of the respondent No. 4-Bank for which the petitioner can claim his salary and can claim his benefits.

The petitioner is terminated in the year 2001 after conducting the departmental inquiry. The challenge to the same is filed before the Labour Court in the year 2018. Today, the petitioner does not have any right or claim against respondent No.4. 3.

In view of that, it would not be appropriate to stall E-auction proceedings on behalf of the petitioner, who as on date, does not have any right.

In light of the above, the writ petition is disposed of. No costs.
