Learned Advocate for the applicant Mr.Narwade has gone through the affidavit in reply filed by Mr.Prabhakar Lalji Dalvi, Incharge District Vocational Education Officer. He has also gone through paragraph No.2 of the said affidavit by which a statement is made that there is only 1 post of "Full Time Instructor" Marketing and Salesmanship, which is sanctioned. Mr.Narwade, therefore, submits that the applicants have got the necessary information by virtue of the said affidavit and hence this civil application can be disposed of on the basis of the same.

Mr.Bora, learned Advocate for respondent No.5 submits that khs/Dec.2015/13632-d

though he has been appointed from the Open Category as he belongs to the Open Category on the position of "Full Time Instructor" Marketing and Salesmanship by virtue of the permission granted by respondent No.3 vide its letter dated 01/12/2006, page No.42 of the petition paper book, his regular full salary has not been paid from 01/04/2013. He states that prior thereto ever since his appointment, he has been paid his regular salary from the salary grants after the Department of Vocational Education had been granting its approval / sanction. He submits that his grievance remains unredressed. 3.

Considering the fact that the applicants pray for the disposal of this civil application in the light of the information received, as recorded above, Mr.Bora may choose to file a civil application for raising any grievance on behalf of respondent No.5. 4.

In the light of the above, this civil application stands disposed of in the light of the affidavit dated 24/11/2015 filed by respondent Nos. 3 and 4.
