BENCH AT AURANGABAD CIVIL APPLICATION NO.9224 OF 2017 (The Manager, Ahmednagar Forgings Limited Vs. Sahebrao Keshav Gerange) IN AND WITH REVIEW APPLICATION ST No.30036 OF 2015 IN WRIT PETITION NO.7635 OF 2012 Mr.U.S.Malte, Advocate for the applicant.

Mr.P.V.Barde, Advocate for the respondent.

( CORAM : Ravindra V.Ghuge, J.) DATE : 12/10/2018 PER COURT :

1.

Heard by consent of the parties. The civil application is allowed and the delay is condoned.

The review application is taken up for hearing by the consent of the parties, forthwith.

3.

Mr.Malte, learned Advocate for the Management places on record a copy of his e-mail communication to the competent officer of the petitioner management, dated 11/10/2018. Same is taken on record and marked as Exhibit "X" for identification.

4.

Mr.Malte then places on record the reply received from the said Officer Mr.P.K.Kumbhar via e-mail dated 11/10/2018. Same is taken on record and marked as "Y" for identification. 5.

Mr.Malte, therefore, submits on instructions 'Y' that the amount of Rs.3,00,000/- deposited in this Court, can be paid with accrued interest to the concerned employee and the entire litigation can be brought to an end.

6.

Learned Advocate for the workman Mr.Barde submits on instructions that as the amount of Rs.3,00,000/- have been deposited by the Management in this Court, the original petitioner/workman is willing to accept the said compensation package subject to being granted accrued interest. Mr.Malte has no objection.

7.

Considering the above, this review application is disposed of in view of the comprehensive settlement between the parties. The workman is permitted to withdraw the entire amount of Rs.3,00,000/- alongwith accrued interest from this Court without conditions as a full and final settlement of his dispute with the Management. The said workman will now be precluded from raising

any further demands which are likely to attract direct or indirect financial burden on the Management. The litigation between the parties arising out of his employment and non employment is therefore brought to an end.
