BENCH AT AURANGABAD WRIT PETITION NO.4695 OF 2016 WITH CIVIL APPLICATION NO. 12250 OF 2017 IN WP/4695/2016 ANAND SHESHRAO BHAROSE

VERSUS

MANOHAR FAKIRA RAUT AND OTHERS ...

Advocate for the Petitioners : Shri S. K. Chavan Manohar Fakira Raut in person as Respondent No.1 Advocate for Respondent Nos. 5 and 9 : Shri A. N. Nagargoje AGP for Respondent Nos. 7 and 8 : Shri S. R. Yadav-Lonikar ...

CORAM : RAVINDRA V. GHUGE, J.

DATED : 10th JANUARY, 2019.

...

PER COURT :

1.

The petitioner in person mentioned this matter at the time of rising of the Court and submitted that he has filed his sur-re-joinder. A glance may be given to the sur-re-joinder and if this Court finds that there is no merit, the petitioner will approach the Honourable Supreme Court for reliefs. 2.

I find that such an attitude of the petitioner in person is not appreciable.

3.

The petitioner desires that his petition should be heard finally as against an interlocutory order. His main Appeal challenging his dismissal on account of misconducts is still pending before the School Tribunal.

4.

This Court is taking up for final hearing matter of 1992 onwards and whenever the situation demands is taking up other petitions for final hearing, as well as, arbitration appeals. 5.

The party in person has filed a Civil Application No. 12250/2017 praying for leave to place a copy of the order of the Honourable Apex Court dated 01/02/2017. He has also prayed for taking the entire special leave petition on record. 6.

The learned Advocate for the Management does not oppose the presentation of the documents annexed to the Civil Application. The C.A. is, therefore, allowed. 7.

Considering that the petitioner is appearing in person, is not conversant with the procedure of the Court and as the case is to be decided within a time frame, the documents which are

252 pages, can be attached separately to the Writ Petition and would be considered while deciding the Writ Petition. 8.

Stand over to 24/01/2019.
