The petition is filed by the petitioner-Educational Institution seeking release of salary grant for payment of non teaching employees as shown in Chart at Exhibit E to the petition. Part of the reliefs claimed in the writ petition stand redressed in view of the affidavit filed on behalf of the respondents. It is also submitted by the learned counsel for the petitioner Institution that employees at Serial No. 1 to 5 have been given regular salary, however, arrears are not paid and as far as employeeMohammad Yunus Zafar Abid( Lab. Asstt) is concerned, salary is not paid to him.

Paragraph 6 of the affidavit filed by the District Coordinator, Office of the Education Officer (Secondary), Zilla Praishad, Dhule, reads as under: 1/2
"6. I say and submit that, in pursuance to the permission granted by the higher authorities, office of the present Deponent has taken effective steps and now regular salary has been started to the employees of the petitioner Institution w.e.f. 12.2008 and now they will get regular salary along-with other similarly situated employees. So far as the due amount of salary is concerned, the Head Master of the school submitted bills to the office of the present Deponent and now in pursuance to the demand of bills, the office of the present Deponent sought grants from the Government to pay the due amount of salary of the employee of the Petitioner Institution. As soon as the office of the Deponent would receive grant, the office of the present Deponent will disburse the same to the employees of the petitioner Institution."

In the light of above, the respondents shall take effective steps even to pay arrears, expeditiously to the concerned employees of the petitioner Institution. The respondents shall also consider the reason why payment is not made to one Mohammad Yunus Zafar Abid( Lab. Asstt) and to take steps accordingly.
