The petitioner seeks appointment on compassionate ground on the post of Clerk or any other suitable post of non-teaching staff.

It is submitted that the name of the petitioner has been kept in the wait list of the persons to be appointed on compassionate ground by respondents no. 1 and 2.

The stand of the respondents no. 1 and 2 is that because of the ban on recruitment the case of the petitioner is not being considered.

The petitioner is seeking appointment on compassionate ground. Certainly, all posts cannot be filled in by persons on compassionate ground. 5.

Respondents no. 1 and 2 shall consider the post available for the persons to be appointed on compassionate ground, and if the post is available for a person to be appointed on compassionate ground, then shall consider the petitioner for appointment on compassionate ground. In that event, the ban on recruitment imposed by the respondent / State would not apply.

Writ Petition stands disposed of accordingly. No costs.
