It appears that by the impugned order dated 20.7.2020 the trial Court has directed that parties shall submit in writing as to wether or not defendant nos. 8, 9, 12 and 14 have taken objection under section 3H of the National Highways Act, 1956 and has deferred the decision on the compromise. The learned counsel for the petitioner submits that petitioner is the senior citizen and that for long period, there has been compromise and there is no further adjudication although the matter came to be fixed on 31.7.2020. The learned counsel submits that there could be no valid objection at the instance of defendant Nos. 8, 9, 12 and 14. However, it appears that it would be more appropriately dealt with by the trial court rather than by this court as the matter is pending before the two forums. 2.
Considering this aspect, the learned Civil Judge, Senior Division, Beed is directed to decide L.A.R. No. 534/2018 as expeditiously as possible, preferably within six months from the date of receipt of this order and also pass order on compromise.
