The Applicant - Shree Sai Baba Sanstha Shirdi has put-forth prayer clause-B as under:
"B) The Applicant may kindly be permitted to implement Resolution No.403 and 418 pursuant to which the applicant is directed to call M/s. Shimadzu Medical (I) Pvt. Limited, Mumbai for negotiation for giving five years service contract for Cathlab machine from 2023 to 2028, and if M/s. Shimadzu Medical (I) Pvt. Limited, Mumbai is not interested in negotiation, in that case, fresh E-tender be called and for implement Resolution No.418 pursuant to which the applicant is directed to call for fresh E tender for yearly service contract for the period 2023-24 of the machines in Sai Baba Hospital
( 2 ) ca 11369.23 and Sainath Rugnalaya and applicant be also permitted to take on-call service till the fresh tender process is completed, looking at the urgency."

After hearing the learned advocates for the Applicant and on perusing the record, we deem it appropriate to permit the Applicant to resort to e-tender process with regard to Resolution No.418 and the concerned company M/s. Shimadzu Medical India Pvt. Ltd., Mumbai would be at liberty to submit their bids.
