Since last 2-3 occasions, none is appearing for the respondent. Therefore, this matter is taken up with the assistance of learned advocate for the applicant.

This application is moved by the applicant - wife seeking transfer of Hindu Marriage Petition No. 94/2019 pending in the Court of learned C.J.S.D., Khamgaon, District Buldhana to the Court of learned C.J.S.D., Parbhani. The application is filed mainly on the ground that, distance between two places is more than 200 kms. The wife is maintaining a daughter of six years

2 943-MCA 291-2024.odt age. One proceeding under sections 498-A and 323 of the Indian Penal Code is pending in the Court of learned J.M.F.C., Jintur. 3.

This Court finds that, the application needs to be allowed. Hence, following order :

ORDER

(I) Misc. Civil Application is allowed in terms of prayer clause (B).

(II) After transfer of the proceeding, the applicant - wife shall not seek unnecessary adjournments. If the learned Court finds that, the adjournments are sought unnecessarily, the learned Court may pass appropriate order compensating the respondent - husband if he remains personally present.

(III) Whenever a request is made by the respondent - husband seeking permission to appear through video conferencing facility, the same shall be considered liberally by the learned Court. (IV) With this, Misc. Civil Application stands disposed of. ( KISHORE C. SANT, J. ) P.S.B.
