The notice issued to respondent No.2, who is the owner of the vehicle, has returned unserved for the reason that he has not been residing on the given address. In fact, he had appeared before the Tribunal wherein his address was mentioned as the same. 3.

In view of above, the application is allowed. The notice to respondent No.2 is allowed to be served by publishing it in the newspaper namely Daily Punyanagari Dhule Edition returnable within ten weeks, at the expenses of the applicant/appellant.
