Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.340 of 2024 registered with Tuljapur Police Station, District Osmanabad for the offences punishable under Sections 310(2) and 281 of the Bharatiya Nyaya Sanhita, 2023.

The applicant was caught hold with the stolen property. The stolen property has been recovered. After his arrest from the spot of the incident, there was no further recovery. This is a first offence against the applicant. Considering the progress in the trial, his detention appears not required. The trial may take its time. Hence, he deserve bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

965-ba-1784-2024.odt (2) (ii) Applicant, Swaraj Balasaheb Kamble, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that ;

(a) The applicant should not tamper with the prosecution witnesses.

(b) The applicant should attend the police station on every Saturday between 02.00 pm to 05.00 pm till the charge sheet is filed.
