Mr. Gaikwad, learned counsel submits that the petitioner has resorted to the remedy under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, 2002.

In light of that the writ petition stands disposed of with liberty to prosecute the application filed by it under Section 17 of the SARFAESI Act.

All contentions of the respective parties are kept open. No costs.
