Mr. Shinde, learned advocate for the petitioner states that the petitioner has filed application/ representation with the Education Officer on 12.05.2015 seeking the pay-scale of a trained teacher and also raising grievance about seniority. Though said application is filed on 12.05.2015, no decision has been taken on it as yet by the Education Officer. Learned advocate further submits that even reminders were given, but no cognizance is taken.

Learned AGP submits that the application of the petitioner has been forwarded to the Management for its say. It is for the Education Officer to decide about the
( 2 ) wp11066.16 entitlement of the petitioner of a particular pay-scale and seniority will also have to be considered by the Education Officer as per Rule 12 of the MEPS Rules. In view of above, we pass following order :- 3.
The Education Officer shall decide the application filed by the petitioner (Exh. "G" collectively) on its own merits, in accordance with law after hearing the petitioner and the management expeditiously, preferably within four months.
