Heard Shri Ashtekar, learned counsel for claimants. Since due steps could not be taken by the applicants/appellants to serve Respondent No.1 through public notice, learned Registrar, vide order passed on 13th February, 2014, has dismissed the first appeal against Respondent No.1. The learned counsel submits that the applicants will take all necessary steps to serve Respondent No.1 by way of public notice.

In view of the undertaking so given by the learned counsel for the

applicants/appellants, the order dated 13.2.2014 passed by learned Registrar is set aside. The appeal stands restored against Respondent No.1. 3.

The learned Counsel is permitted to Respondent No.1 by way of paper publication to be published in local newspaper, viz. Karnataka Prabhat, Humnabad and submit affidavit of service. CA stands disposed of. Notice be made returnable on 22-10-2018.
