Since all these petitioners, who have superannuated, are identically placed with those employees, who have benefited all over the State, these matters were adjourned to enable the learned A.G.P. to take instructions.

In writ petition No. 6467 of 2021, filed by Zoeb Husain Dini and others vs. State of Maharashtra and others, at the Principal Seat, the Deputy Director, Directorate of Technical Education, Mumbai, Shri Mahendra Keshaw Dawane, has filed an affidavit in reply, dated

-26.7.2022. The relevant portion of the said affidavit in reply, reads thus:- "2.

I say that the Respondent No.2 by an order dated 6.1.2022 and 02.02.2022, has approved the revised pay fixation of the petitioners as per 5th, 6th and 7th Pay Commission as applicable to the Petitioners. Hereto annexed and marked as Exhibit 1 (Colly) is the copy of the order dated 6.1.2022 and 2.2.2022.

I say that after following due procedure for disbursement of arrears, the arrears were credited to the respective bank account of Petitioners by the respective Joint Director Offices vide letter dated 8.3.2022, 30.3.2022 and 31.3.2022. Hereto annexed and marked as Exhibit 2 (Colly) is copies of the letter dated 15.3.2022 and 17.6.2022.

I say that Respondent No.2 vide its letter dated 11.3.2022 and 22.3.2022 forwarded the proposals for revised pension of the petitioners to The Accountant General office, Mumbai of Pension. Hereto annexed and marked as Exhibit 3 (Colly) is copies of the letter dated 11.3.2022 and 22.3.2022.

I say that the Accountant General office Mumbai of pension vide order dated 13.4.2022, 22.4.2022 and 29.4.2022 has sanctioned the revised pension to the petitioners. Hereto annexed and marked as Exhibit 4 (Colly) is copies of the letter dated 13.4.2022, 22.4.2022 and 29.4.2022."

The learned A.G.P. submits that the pay fixation of these petitioners has been revised on 25.11.2022, which has been communicated to them vide communication from respondent No.3. He further submits that the procedure that was adopted in Zoeb Husain Dini's case (supra), evident vide reproduced paragraphs above, the respondent would require around four months to pay the arrears to these petitioners and revise their pension. 4.

The learned advocate for the petitioners submits that they are satisfied.

In view of the above, both these petitions are disposed off. We expect that, the respondent authorities would ensure that the revised pension and the arrears are paid to these petitioners on or before 15.04.2023.
