Mr.Ambetkar, learned counsel submits that the present petitioners had applied for the post of Shikshan Sevak from open, Scheduled Caste and Other Backward Class category. The list of the marks obtained by the various students is

2 W.P.No.10210/16 placed on record. The said list would show that even the candidates who had obtained less marks than the petitioners are appointed.

Mr.Nikam, learned counsel for Respondent No.2 submits that the petitioners are considered from the respective categories from which they had applied. No candidate securing less marks than the petitioners have been appointed in their respective categories. The list relied by the petitioners is the earlier list. Subsequently, the list is modified on reverification.

The case of the petitioners is considered by the Respondents from the respective categories as per their applications. The statement is made by Mr.Nikam, learned counsel that no candidate having less marks than the petitioners have been appointed in the respective categories. The said statement is accepted. Accepting the said statement, the contention of the petitioners can not be accepted.
