The applicant was convicted for an offence punishable under section 138 of the Negotiable Instruments Act and sentenced to suffer S.I. For two months and to pay compensation of Rs.3,00,000/-, in default to suffer S.I. for two months, by judgment and order dated 6th February, 2013, passed by learned Judicial Magistrate First Class, Amalner, which has been confirmed by learned Additional Sessions Judge, Amalner vide judgment and order dated 13th September, 2016, passed in Criminal Appeal No.6 of 2013.

It is informed by the learned Counsel appearing on behalf of the applicant that of the amount of Rs.3,00,000/-, the applicant has already deposited and an amount of Rs.60,000/- and undertakes to deposit

criap5456.16 (2) amount of Rs.1,00,000/- within a period of four weeks from today. The statement made by the learned Counsel, upon instructions, is accepted. Hence, substantive sentence is suspended and the applicant be admitted to bail on the same terms on which he was admitted to bail by the learned Trial Court.
