Mr. Hon, learned senior counsel for the petitioner submits that, the petitioner is Chairman of the Panchayat Samiti, Shrirampur for a term of two and half years. She is elected on 07.01.2020. The petitioner is disqualified by the Collector. The petitioner filed an Appeal before the Hon'ble Minister. The same is pending. The petitioner is given 30 days time to file an Appeal. Before the said period, the Collector has declared election for the post of Chairman of the Panchayat Samiti, Shrirampur on 09.11.2021 and election is scheduled on 18.11.2021.

Mr. Kale, learned counsel appears for respondent no.5 and submits that, the Hon'ble Minister has kept the matter for hearing on 16.11.2021 and respondent no.5 has received notice of hearing.

In that case, the petitioner can appear before the Hon'ble Minister on 16.11.2021, so also respondents.

The Hon'ble Minister shall pass orders on the application for stay and/or such other applications which the petitioner may have filed prior to 17.11.2021 on its own merits considering the fact that elections are scheduled on 18.11.2021.

The copy of the order passed by the Hon'ble Minister be served to the petitioner immediately.

Writ Petition is disposed of. No costs.
