The petitioner has alternative remedy of filing Misc. Civil Appeal before the District Court challenging the order dated 11th October, 2022 passed by the Civil Judge, Senior Division, Osmanabad on application below Exh. 62. Learned Counsel appearing for the petitioner, on instructions, seeks leave to withdraw the petition with liberty to approach the District Court for filing the Misc. Civil Appeal.

The learned Counsel appearing for respondent No. 4 makes a statement that respondent No. 4 has so far withdrawn only 1/4th amount of compensation. For a period of three weeks from today respondent No. 4 shall not withdraw any further amount of

With these directions the petition is dismissed as withdrawn.
