Heard learned counsel for the applicant and the learned counsel for the respondents.

The learned counsel for the applicant submits that, this Court has permitted the applicant to withdraw 50% amount alongwith accrued interest thereon on furnishing undertaking and 25% amount alongwith accrued interest thereon on furnishing solvent surety/security or Bank guarantee. The applicant is 82 years old lady. Due to ailments she is unable to come to Aurangabad. Hence, requested to transfer the above referred amount to the learned Reference Court. 3.

The learned counsel for the respondents submits that, an appropriate order be passed.

Considering the submissions of both the learned counsels and the reasons mentioned in the application, application is allowed in terms of prayer Clause 'B'.

The applicant shall file undertaking before the learned Reference Court.
