The petitioner takes exception to the order refusing to grant interim relief, passed by Maharashtra Administrative Tribunal (MAT), Aurangabad. The petitioner was one of the candidates in the recruitment process for the post of Junior Geologist. The petitioner, in terms of advertisement, was required to submit SEBC certificate along with Non Creamy Layer certificate by 07.10.2024. However, due to administrative delay, the Non Creamy Layer certificate was issued only on 08.10.2024, i.e. one day beyond the stipulated date. Due to which, petitioner was declared non-eligible candidate and was disqualified for interview.

Be that as it may. The petitioner wants parity in terms of the order passed by this Court, Bench at Kolhapur. The copy of the said

929.odt order is on record. The respondents therein were directed to permit the petitioner therein, to appear for interview.

In the case in hand, however, the interview process is said to have been over about a month before. The Original Application is still pending before the MAT. The next date therein is fixed for 07.11.2025.

In our view, purpose would be served if MAT is directed to decide O.A. within time frame. We, therefore, direct the MAT to decide the petitioner's application on its own merits within a time frame of one month without being influenced by observations of this Court made herein above.
