1] Heard learned counsel for the applicant and the learned APP for the respondent-State.

2] The applicant is apprehending arrest in connection with Crime No. 288/2024, registered with Shivoor Police Station, Dist. Aurangabad, for the offence punishable under Section 420 of the IPC.

3] This Court, by order dated 27.01.2025, has granted interim protection in favour of the applicant for the submissions stated in para nos. 3 and 4, as noted below : 3.

The learned Counsel for the applicant submits that he is also a victim of the crime. He states that he received money from some

intended customers who wished to travel to Haj, amounting to Rs.45,000/- per person, and transmitted the same to Shaikh Kamruddin and Shaikh Mehjabin. The learned Counsel further submits that he, along with his family members, relatives, and friends, also intended to go to Haj and had personally paid money to the said persons. He claims that he acted as a middleman between Shaikh Kamruddin and Shaikh Mehjabin. 4.

He states that he made a payment of approximately Rs.9,45,000/- through PhonePe and a total of Rs.17,05,000/-, including Rs.7,60,000/- in cash. The learned Counsel for the applicant assures the Court that he is ready to cooperate with the investigation and will attend the police station as required.

4] The learned counsel for the applicant submits that in pursuance of the aforesaid order, the applicant has attended the concerned police station and has co-operated with the investigation. He further submits that the applicant as settled the dispute with the complainant and other witnesses.

5] The learned APP, on instructions, is not disputed the aforesaid facts. The Investigating Officer is present in the Court.

6] In view of the above, the interim protection granted by order dated 27.01.2025 stands confirmed in the following terms :

i] The applicant shall attend the concerned police

station as and when required by the investigating officer.

ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case.

iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.

7] In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled.

8] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.

9] The application stands disposed of.
