Learned counsel Mr. Bajaj for appellants, on instructions, submits that, the appeal is to be withdrawn. Hence, the appeal is disposed of as withdrawn.

The appellants will be entitled to refund of half court fee as per sub-rule (4) of para 499 of the Civil Court Manual Rules made under the Bombay Court Fees Act, 1859. Refund of Court fees be issued accordingly.
