1) Heard. The petitioner claims to belong to "Thakur", Scheduled Tribe category. She has secured an admission in Respondent No.3-College, to Pharmacy Course as against a seat earmarked for ST category. The petitioner states that the caste validation proposal tendered with the Caste Scrutiny Committee in the year 2009 is still pending. As a result of failure of the petitioner to submit Caste Validity Certificate, the Respondent-College has issued a notice on 4th August, 2015, calling upon the petitioner to tender Caste Validity Certificate and it has further been informed to the petitioner that in the event of her failure to submit the Caste Validity Certificate, her admission shall be liable to be cancelled.
2) In the facts and circumstances of the case, this petition can be disposed of by directing Respondent No. 4 - Caste Scrutiny Committee to take a decision on the caste claim tendered by the petitioner in the year 2009 and which is pending with the Committee, as expeditiously as possible, and preferably within a period of six months from today and it is accordingly directed. In the meanwhile, Respondent No.4-College shall not take any coercive action against the petitioner on the ground of her failure to submit the Caste Validity Certificate. 3) With the directions, as above, the writ petition is disposed of.
