The applicant is seeking pre-arrest bail in Crime No. I-41/2015 registered at Bamni Police Station, Dist. Parbhani, for the offence punishable under Sections 307, 324, 323, 143, 149, 147, 148, 452, 326, 336, 504, 506 of Indian Penal Code and under Section 135 of Bombay Police Act.

The attribution against the present applicant in the F.I.R. appears that, the applicant, being a son of Sarpanch, used knife in commission of crime and resulted in causing injuries to the

-2complainant and one other person and has committed such offence in question. It appears that,the allegations in the F.I.R. are in the background of elections in the village panchayat. There is another crime No. 42/2015 registered against the complainant at the behest of member of village panchayat.

It is required to be noted that, the applicant herein alleged to have used knife in the commission of crime in question, which has resulted into causing injuries to the complainant and one other person and as such, offence under Sections 307 of the Indian Penal Code was registered.

The perusal of the investigating papers reflects that, the medical report of the injured speaks of simple injuries, which were caused by hard and blunt object.

In view of above, false implication of the applicant in crime in question cannot be ruled out. In this back ground, it will be appropriate, in my opinion to grant bail to the applicant. Hence, I propose to pass the following order :- (a) In the event of arrest, the applicant be released on bail, upon executing the P.R. bond of Rs.15,000/-

-3- (Rs. Fifteen thousand) with one surety in the like amount, in connection with Crime No. I-41/2015 registered at Bamni Police Station, Dist. Parbhani, for the offence punishable under Sections 307, 324, 323, 143, 149, 147, 148, 452, 326, 336, 504, 506 of Indian Penal Code and under Section 135 of Bombay Police Act.

(b) The applicant shall attend the concerned police station initially for three days in between 10.00 a.m. to 11.00 a.m. and thereafter as and when called. 6.

The application stands allowed.
