The applicant is apprehending arrest in Crime No. 396/2021 registered with Pachora Police Station, Taluka Pachora, District Jalgaon for the offence under sections 461, 380, 34 of Indian Penal Code.

The applicant was granted interim protection by order dated 24th November 2021 with direction to attend the Investigating Officer on 1st, 2nd and 3rd December, 2021 between 11.00 a.m. to 1.00 noon. Thereafter the matter was heard on 13th December, 2021. 3.

The learned APP submitted that the directions to appear before the Investigating Officer are not fully complied by the applicant. Although he had appeared before the Investigating Officer on 1st December, 2021, he did not appear on 2nd and 3rd December, 2021.

ABA No.1371/21 With a view to give opportunity to applicant to rectify his lapse, by order dated 13.12.2021 applicant was directed to appear before the Investigating Officer on 16th and 17th December, 2021 between 11.00 a.m. to 1.00 noon. Learned APP submits that the applicant had not complied the directions of this Court and did not appear on 16th and 17th December 2021 before the Investigating Officer. 4.

The learned advocate for the applicant submits that the order was communicated to the applicant.

It is apparent that the applicant is not willing to co-operate with the investigation. He has not complied the directions of this Court inspite of giving opportunity to appear before the Investigating Officer on 16th and 17th December, 2021. The applicant did not deem it necessary to attend the Investigating Officer. He is flouting the orders of this Court. Considering the aforesaid circumstances, the application stands rejected and disposed of. Interim relief stands vacated. [ PRAKASH D. NAIK, J. ] ssc/
