Heard the learned counsel for the applicant, the learned A.P.P. for respondent No.1 and the learned counsel for respondent No.2.

The applicant seeks bail in C.R.No.414of 2024 registered with Rahuri Police Station, District Ahmednagar, for the offences punishable under Sections 363, 366 of the Indian Penal Code and Section 12 of the Protection of Children from Sexual Offences Act. 3.

Perusal of the statement of the victim who was around sixteen years old at the time of incident, does not indicate that the applicant outraged her modesty. On the contrary, he made a phone call to father that he was with the victim. Then he took the victim to his village and then police arrested them.

Considering the acts of the applicant and no use of force, he deserve bail. Hence, the order:-

ORDER

i) The application is allowed.

ii) Applicant - Ravindra Bhausaheb Barde be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution witnesses. (b) He should not contact the victim till the trial is concluded.

(c) He should attend the trial on each and every effective date.

iii) The Secretary, High Court Legal Services Sub-Committee, Aurangabad, do pay the fee to the learned counsel appointed for respondent No.2/victim, as per the schedule. ( S. G. MEHARE ) JUDGE rrd
