The application is filed by original claimants for permission to withdraw the compensation amount which is deposited by the Insurance Company in the appeal. Both the sides are heard.

It appears that the Insurance Company has challenged the decision of the Tribunal on the ground that when there is a breach of conditions of policy, order is made against the Insurance Company to deposit the amount. It appears that the Tribunal has given right to the Insurance Company to recover the amount from

-:(2):- 14057 Respondent Nos.1 and 2 jointly and severally. Thus, the right is given to recover the amount from owner of the vehicle. There is no other challenge. In view of above, permission is granted to the Applicants to withdraw the amount of compensation subject to giving undertaking. Application is allowed accordingly.
