Learned counsel for the parties are at ad idem to pass order similar to one passed by this Court on 03.07.2018 in Civil Application No.4471 of 2018 in First Appeal No.3120 of 2016 and connected matter.

In view of the above, following order is passed :- (i) The application is partly allowed.

(ii) The applicant-original claimant is permitted to withdraw 75% of the amount deposited in this Court; 50% be paid on furnishing

CA-12690-2018 usual undertaking to the satisfaction of learned Registrar (Judl.) of this Court; and 25% be paid on furnishing solvent security/surety. (iii) Balance amount be kept in fxed deposit with any nationalised bank until decision of this appeal. (iv) Accordingly, the Civil Application stands disposed of in above terms.
