The Applicant/State of Maharashtra, by this application, has prayed for an extension of 3 months time in order to comply with the directions of this Court set out in paragraph No.9 of the order dated 16/01/2015 delivered in CA No.13148/2014.

The applicant has explained in paragraph Nos.4 to 7, the circumstances in which they were unable to comply with the directions of this Court within the time frame, which expired on

31/07/2015.

It is submitted by the learned AGP on instructions from the representative of the applicant present in the Court that the applicant would make every endeavour to ensure that the order dated 16/01/2015 shall be complied with.

Learned Advocate appearing on behalf of the non-applicants has opposed the application on the ground that a long period of 6 months was granted to the applicant. Alternatively, he submits that in the event the applicant complies with the order expeditiously, an extension of 1 (one) month may be granted.

Having considered the submissions of the learned AGP and the learned Advocates for the non-applicants, this application is partly allowed in light of the fact that the applicant has already consumed more than 10 weeks pursuant to the expiration of the period granted in the order, which was upto 31/07/2015.

As such, the applicants shall ensure that the directions of this Court in paragraph No.9 of the order dated 16/01/2015 are complied with, on or before 30/11/2015, failing which, the stay granted to the

criminal proceeding pending before the Labour Court, Latur in paragraph No.10 of the said order, shall stand automatically vacated without further reference to this Court.
