The petitioner herein is an accused in a case instituted under Section 138 of the Negotiable Instruments Act. Recording of evidence has been over long back. It is informed that the matter has been kept for advancing oral arguments. Both the parties have already submitted written notes of argument.

In this factual scenario, this Court is not inclined to quash and set aside the order rejecting the application for transfer of case from the concerned Magistrate to the another Court. The petitioner would have every 1 / 2

912-WP-1323-21.odt remedy to challenge the verdict, if the same goes against him. The petitioner is expected to advance his oral submission (argument in the case) before the Court concerned within a period of one month from the date of this order. 4.

Criminal writ petition is dismissed.
