This is an application for condonation of delay. Mr.Garud, learned counsel submits that the applicant was not aware of the judgment and decree passed by the Family Court. He was not served with the summons.

Mr.Sarvadnya, learned counsel for the Respondent submits that the applicant was served by email and had the knowledge of the judgment and decree. It is a fact that the petitioner did not appear in the proceedings. In the application for condonation of delay, we are only considering the grounds stated for condonation that he is not aware of the judgment and order passed.

In light of that, the Civil Application is allowed. Delay is condoned.

The Civil Application is disposed of.
