Heard learned counsel for the applicant/original claimant and learned counsel Shri Bodade for respondent No2 Insurance company. Despite service of notice, no one else appeared for respondent No.1.

Present application is filed seeking condonation of 137 days delay for filing first appeal against impugned judgment and award passed by the MACT Ahmednagar in MACP No. 415 of 2006.

Perused the application.

In view of reasons mentioned in the application, there is no impediment to condone the delay of 137 days caused in filing the first appeal. Accordingly, the application stands allowed in terms of prayer clause (B). Delay caused for filing the first appeal is hereby condoned. Registry to take requisite steps for further process. On registration of appeal, issue notice to respondents returnable on 24th July, 2018. Learned counsel Mr. S.R. Bodade waives service for respondent No.2.
