The petitioner is seeking directions to the Sub Divisional Officer, Nanded to take decision on the application tendered by him for issuance of tribe certificate certifying that he belongs to Koli Mahadev, Scheduled Tribe.

According to the petitioner, the application is presented in June 2015 claiming tribe certificate, however, the Sub Divisional Officer has not processed the application and has not taken any decision in respect of issuance of certificate. It is the contention of petitioner that his brother is validity certificate holder issued by the competent Scrutiny Committee and as such, this fact itself entitles the petitioner to claim the tribe certificate. In the facts and circumstances, this petition stands disposed of with directions to the Sub Divisional Officer, Nanded,

{2} wp1028615.odt to take decision on the application tendered by the petitioner to issue tribe certificate in favour of the petitioner, as expeditiously as possible, preferably within a period of one week from today. The Sub Divisional Officer shall consider the aspect of issuance of validity certificate in favour of brother of the petitioner, which evidence, prima facie, is sufficient to issue tribe certificate in favour of the petitioner.
