IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.11860 OF 2025 Sanket s/o Sanjay Sidhewad ... PETITIONER

VERSUS

The State of Maharashtra & anr.

... RESPONDENTS .......

Mr. S.M. Vibhute, Advocate for petitioner Ms R.P. Gaur, A.G.P. for State .......

CORAM : R.G. AVACHAT AND ABASAHEB D. SHINDE, JJ.

DATE : 29th SEPTEMBER, 2025 O R D E R :

Heard. The petitioner claims to have belonged to "Mannervarlu", Scheduled Tribe. The petitioner's tribe certificate was subjected to scrutiny. The Scrutiny Committee refused to grant validation to the petitioner's tribe certificate. He is, therefore, before us.

2.

The fact is that, the petitioner's real cousins have been granted validity certificates vide orders passed by this Court in two Writ Petitions, namely Writ Petition

Writ Petition No.11860/2025 :: 2 ::

No.13809/2023 and Writ Petition No.8615/2025. The relationship between the petitioner and those validity holders is not in dispute before us. In our view, therefore, the petitioner deserves to be granted validity certificate. The validity certificate to be granted to the petitioner would hold the field until the certificates granted to the petitioner's cousins hold. 3.

In the result, the Writ Petition is partly allowed. The impugned order dated 3/9/2025, passed by the respondent Scrutiny Committee is hereby set aside. The Committee shall issue certificate of validity of "Mannervarlu", Scheduled Tribe to the petitioner immediately. The same would be subject to the final outcome of the matters of the cousins of the petitioner which the Committee had decided to reopen.

4.

The petitioner shall not be entitled to claim equity. (ABASAHEB D. SHINDE, J.) (R.G. AVACHAT, J.) FMPathan/-
