This is an appeal fled on behalf of the State challenging the judgment and order of acquittal passed by the learned Ad hoc Additional Sessions Judge, Osmanabad, in Criminal Appeal No. 25 of 2007, dated 06.03.2012, acquitting Respondent - Madhavrao Bhaurao Dharwad, for the offence punishable under Section 409 of the Indian Penal Code. This appeal was admitted.

During pendency of the appeal, Respondent - Madhavrao Bhaurao Dharwad passed on 16.06.2021. Copy of the

{2} crappeal67814.odt Death Certifcate is placed on record, which is marked Exhibit "X" for the purposes of identifcation. Exhibit "X", issued by the Sub Registrar, Birth & Death, Nanded Waghala City Municipal Corporation, Nanded, shows that Respondent Madhavrao Bhaurao Dharwad passed on 16.06.2021.

The learned A. P. P. Shri A. V. Deshmukh submits that he has instructions to make a statement that the Respondent is no more and the death certifcate (Exhibit "X") is issued by the competent authority. The statement is accepted. In view of the same, Criminal Appeal No. 678 of 2014 stands abated and disposed of as such.
