We have heard Mr. Barlota, the learned advocate for the applicant, the learned A. G. P. for respondents/state and Mr. Undre, the learned advocate for the contesting respondents. 2.

It appears that, the amendment sought to be introduced is subsequent event. The order dated 01.10.2021 passed by the Deputy Commissioner State Excise is also sought to be assailed. 3.

Even otherwise, the non applicants will have every opportunity to controvert the averments sought to be introduced by way of amendment. The petition is at nascent stage.

In the light of that, the civil application is allowed in terms of prayer clause "B" for amendment. The civil application is disposed of.

The amendment be carried out within a period of fourteen
